Please read these Terms of Service carefully before using SocialEye. By accessing or using our services, you agree to be bound by these terms. If you do not agree to all of these terms, do not use our services. These terms contain important limitations on our liability and your use of the platform.
1. Agreement to Terms
By accessing or using SocialEye ("Service," "Platform," "we," "us," or "our"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations. These Terms constitute a legally binding agreement between you and SocialEye.
1.1 You represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
1.2 We reserve the right to modify these Terms at any time. Continued use of the Service after any changes constitutes acceptance of the new Terms. It is your responsibility to review these Terms periodically.
1.3 If you do not agree to these Terms, you must immediately discontinue use of the Service and delete any data obtained through the Service.
2. Service Description & Data Disclaimer
SocialEye provides threat intelligence, breach data lookup, and open-source intelligence (OSINT) services for cybersecurity research, fraud prevention, and security assessment purposes.
2.1 DATA SOURCES AND ACCURACY. The information provided through our Service is compiled from various publicly available sources, third-party data providers, and leaked/breached databases that have been made publicly accessible. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, TIMELINESS, OR RELIABILITY OF ANY INFORMATION PROVIDED THROUGH THE SERVICE.Data may be outdated, incorrect, incomplete, or derived from unverified sources.
2.2 NO HACKING OR UNAUTHORIZED ACCESS. SocialEye does not engage in, facilitate, or condone any unauthorized access to computer systems, networks, or databases. All data provided through our Service has been obtained from publicly accessible sources or authorized data providers. We are a data aggregation and search service only.
2.3 RESEARCH PURPOSES. The Service is intended for legitimate security research, threat intelligence analysis, fraud prevention, identity verification, and authorized security assessments. Users are solely responsible for ensuring their use complies with all applicable laws.
2.4 NO ENDORSEMENT. The inclusion of any data in our Service does not constitute an endorsement or verification of that data. We make no representations about the validity or authenticity of any information provided.
3. User Responsibilities & Acceptable Use
3.1 LAWFUL USE ONLY. You agree to use the Service only for lawful purposes and in compliance with all applicable local, state, national, and international laws and regulations. You are solely responsible for determining whether your use of the Service is legal in your jurisdiction.
3.2 AUTHORIZED PURPOSES. You may use the Service only for:
- Security research and threat intelligence analysis
- Protecting your own organization's security posture
- Fraud prevention and detection with proper authorization
- Authorized penetration testing and security assessments
- Academic and educational research
- Verifying your own data exposure
- Compliance and risk assessment purposes
3.3 ACCOUNT SECURITY. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.
3.4 ACCURATE INFORMATION. You agree to provide accurate, current, and complete information when creating an account and to update such information as necessary.
4. Prohibited Activities
You expressly agree NOT to use the Service for any of the following prohibited purposes:
- Harassment or Stalking: Using data to harass, stalk, threaten, or intimidate any individual
- Identity Theft: Committing or facilitating identity theft, fraud, or impersonation
- Unauthorized Access: Attempting to gain unauthorized access to any system, network, or account
- Blackmail or Extortion: Using data for blackmail, extortion, or any form of coercion
- Spam or Phishing: Sending unsolicited communications or conducting phishing attacks
- Doxxing: Publishing private information about individuals without consent
- Discrimination: Using data to discriminate against individuals based on protected characteristics
- Reselling: Reselling, redistributing, or commercializing our data without authorization
- Automated Scraping: Using automated tools to scrape or extract data beyond API limits
- Circumvention: Attempting to bypass security measures or usage restrictions
- Illegal Activities: Any activity that violates applicable laws or regulations
- Harm to Minors: Any use involving data related to minors for harmful purposes
Violation of these prohibitions may result in immediate account termination, reporting to law enforcement, and civil or criminal liability.
5. Limitation of Liability
PLEASE READ THIS SECTION CAREFULLY AS IT LIMITS OUR LIABILITY TO YOU.
5.1 DISCLAIMER OF WARRANTIES. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
5.2 NO GUARANTEE. WE DO NOT WARRANT THAT: (A) THE SERVICE WILL MEET YOUR REQUIREMENTS; (B) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE RESULTS OBTAINED FROM THE SERVICE WILL BE ACCURATE OR RELIABLE; (D) ANY ERRORS IN THE SERVICE WILL BE CORRECTED.
5.3 LIMITATION OF DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SOCIALEYE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
5.4 MAXIMUM LIABILITY. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED US DOLLARS ($100).
5.5 BASIS OF THE BARGAIN. YOU ACKNOWLEDGE AND AGREE THAT WE HAVE OFFERED THE SERVICE AND ENTERED INTO THESE TERMS IN RELIANCE UPON THE DISCLAIMERS AND LIMITATIONS OF LIABILITY SET FORTH HEREIN, AND THAT THESE FORM AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN US.
5.6 DATA ACCURACY. WE ARE NOT LIABLE FOR ANY DAMAGES OR LOSSES ARISING FROM YOUR RELIANCE ON ANY DATA, INFORMATION, OR RESULTS PROVIDED THROUGH THE SERVICE. YOU USE ALL DATA AT YOUR OWN RISK.
6. Indemnification
6.1 You agree to indemnify, defend, and hold harmless SocialEye, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Your violation of any third-party rights
- Any claim that your use of the Service caused damage to a third party
- Any data you submit, post, or transmit through the Service
6.2 This indemnification obligation will survive the termination of your account and these Terms.
7. Intellectual Property
7.1 OUR PROPERTY. The Service, including its original content, features, functionality, design, and underlying technology, is owned by SocialEye and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.
7.2 LIMITED LICENSE. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your authorized purposes, subject to these Terms.
7.3 THIRD-PARTY DATA. The data provided through the Service may be subject to third-party intellectual property rights. We make no representations regarding your right to use such data beyond the scope permitted by these Terms.
8. Termination
8.1 BY US. We reserve the right to suspend or terminate your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
8.2 BY YOU. You may terminate your account at any time by contacting us or using account deletion features. Termination does not entitle you to any refund of fees paid.
8.3 SURVIVAL. The following sections shall survive termination: Limitation of Liability, Indemnification, Intellectual Property, Governing Law, and any other provisions that by their nature should survive.
9. Governing Law & Dispute Resolution
9.1 GOVERNING LAW. These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
9.2 ARBITRATION. Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in the United States, and judgment on the award may be entered in any court having jurisdiction.
9.3 CLASS ACTION WAIVER. YOU AGREE THAT ANY CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
9.4 TIME LIMITATION. Any claim or cause of action arising out of or related to these Terms or the Service must be filed within one (1) year after such claim or cause of action arose, or be forever barred.
10. General Provisions
10.1 ENTIRE AGREEMENT. These Terms, together with our Privacy Policy, constitute the entire agreement between you and SocialEye regarding the Service and supersede all prior agreements and understandings.
10.2 SEVERABILITY. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
10.3 WAIVER. Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.
10.4 ASSIGNMENT. You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights and obligations without restriction.
10.5 FORCE MAJEURE. We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control.
